1. Licence Grant
QC Pro Apps Ltd grants you a limited, non-exclusive, non-transferable, revocable licence to download and use the application on any Apple device that you own or control, subject to the terms of this EULA and the Apple App Store Terms of Service.
This licence does not permit you to use the application on any device not owned or controlled by you, or to distribute or make the application available over a network where it could be used by multiple devices at the same time (other than features specifically designed for that purpose).
2. Restrictions
You may not:
- Copy, modify, adapt, translate, or create derivative works of the application
- Reverse-engineer, decompile, disassemble, or attempt to extract the source code
- Rent, lease, sell, sublicense, or transfer the application to any third party
- Use the application for any illegal purpose or in violation of any applicable law
- Remove or alter any proprietary notices, labels, or marks on the application
- Use the application to infringe the intellectual property rights of any third party
3. Subscription and Payments
Certain features of the application require a paid subscription. Subscriptions are billed on a monthly or annual basis through the Apple App Store In-App Purchase system or via Stripe on the web portal. Prices are displayed before purchase and may vary by region.
Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. You can manage or cancel subscriptions in your Apple ID Account Settings or in the web portal. No refunds are given for partial periods, except where required by applicable law.
4. Intellectual Property
The application, including all content, features, and functionality, is owned by QC Pro Apps Ltd and is protected by copyright, trademark, and other intellectual property laws. You are granted a licence to use the application only as expressly stated in this EULA.
Content you create using the application (such as weld audit reports, inspection records, and compliance documents) remains your property. You grant QC Pro Apps Ltd a non-exclusive licence to store and transmit such content solely for the purpose of providing the service.
5. Privacy
Our Privacy Policy governs the collection and use of your personal data. By using the application, you consent to the collection and use of data as described in our Privacy Policy and GDPR Statement.
6. Disclaimer of Warranties
The application is provided "as is" without warranty of any kind, express or implied. QC Pro Apps Ltd does not warrant that the application will be error-free, uninterrupted, or free from viruses or other harmful components.
The application is a tool to assist professionals in their work. It does not replace the judgement of a qualified professional. QC Pro Apps Ltd expressly disclaims any liability for decisions made based solely on output from the application.
7. Limitation of Liability
To the maximum extent permitted by law, QC Pro Apps Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the application. Our total liability to you shall not exceed the amount you paid for the application in the 12 months preceding the claim.
Nothing in this EULA limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
8. Termination
This licence is effective until terminated. QC Pro Apps Ltd may terminate this licence immediately if you breach any term of this EULA. On termination, you must stop using the application and delete all copies from your devices.
You may terminate this licence by deleting the application from all devices and cancelling any subscriptions.
9. Apple-Specific Terms
This EULA is between you and QC Pro Apps Ltd only, not with Apple. Apple is not responsible for the application or its content. Apple has no obligation to provide maintenance, support, or warranty services for the application. In the event of any failure of the application to conform to applicable warranties, you may notify Apple, and Apple will refund the purchase price for the application to you (if any). To the maximum extent permitted by law, Apple will have no other warranty obligation with respect to the application.
Apple is not responsible for addressing any claims you or any third party may have relating to the application, including product liability claims, consumer protection claims, or intellectual property infringement claims.
10. Governing Law
This EULA is governed by the laws of Scotland and the United Kingdom. Any disputes shall be subject to the exclusive jurisdiction of the courts of Scotland.
